
The patent case HTC filed against Apple holds credence, a US judge has said.
U.S. International Trade Commission (ITC) Judge Thomas Pender stated that “clear and convincing means something to me,” in regards to the legalities pertaining to seeing whether a patent should or should not have been issued. ”I have to be pretty darn certain a U.S. patent is invalid,” he added.
HTC had accused Apple of infringing two patents relating to 4G technologies, which the iPhone 5 is expected to feature.
If Apple is found guilty in infringing HTC’s patents, a U.S. import ban on iPad and iPhone 5 may very well come into affect.
Meanwhile, Apple will announce the iPhone 5 on Wednesday, September 12th.
